Not only does the firm have experienced attorneys to review real estate matters, the firm also has a real estate department which includes a licensed abstractor , a closing agent and title insurance agents.
An abstractor reviews the public record at the County Recorder's Office and makes a written report regarding the items that effect a certain parcel of property. A closing agent provides services to close real estate purchases and refinances. The law firm of Anderson & Burgett has specific individuals on staff who specialize in these two areas.
In addition to complete closing services, the law office of Anderson & Burgett completes other specialized real estate matters including but not limited to purchase agreement, title opinions, title insurance (owner's and mortgagee), quiet title action, transfer of real property between family members, development and/or platting assistance, easement agreements, and all types of other real estate documents.
REAL ESTATE DEFINITIONS
ABSTRACT OF TITLE - a condensed history or summary of all transaction affecting a particular tract of land.
CLOSING - a meeting with the closing agent, buyer, seller, realtor, and/or loan officers wherein documents including but not limited to the Warranty Deed, Mortgage, Settlement Statement, are signed. If the closing is for a purchase of property, funds are dispersed to various parties on the day of closing. If the closing is for a refinance, documents are signed at closing, but funds are usually not disbursed for three business days.
EASEMENT AGREEMENT - a binding agreement between two parties for the right to transverse the other parties' property for various uses including driveways, utilities, farming, and other uses.
ESCROW AGREEMENT - a document in which the parties (Buyer and Seller) agree to allow a third party (usually Anderson & Burgett) to handle funds for items not completed before the closing.
MORTGAGEE'S TITLE INSURANCE POLICY - a document which protects against loss of the lender's interest in certain property due to legal defects in title.
OWNER'S TITLE INSURANCE POLICY - a document which protects against loss of the owner's interest in certain property due to legal defects in title.
PURCHASE AGREEMENT - a legally binding contract to sell a parcel of real property.
TITLE OPINION - a document generated by an attorney, giving his or her opinion, based on the information in the Abstract of Title or Title Search, as to whether the seller has good and marketable title.
